These Terms of Service ("Terms") govern your access to and use of Hogmatix ("the Service"), operated by Forge Analytics & Systems Inc. ("we", "us", or "our"), a company incorporated in Ontario, Canada. By creating an account or using the Service, you agree to be bound by these Terms.
You must be at least 13 years of age to use Hogmatix. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into a binding agreement.
Hogmatix is a social media scheduling and automation platform that allows users to connect their social media accounts (including X/Twitter, TikTok, and YouTube), generate creative media, measure supported public-post metrics, and schedule or publish content through official platform APIs. TikTok posts remain subject to a final creator review and explicit approval before any post is submitted.
You may connect an AI assistant, such as ChatGPT, to your Hogmatix account. A connected assistant acts only within the permissions you approve on hogmatix.com and can view your connected accounts, scheduled posts and plan, and schedule or cancel posts at your request. You are responsible for reviewing what the assistant schedules for you, just as you would in Hogmatix itself. Your use of the assistant is also subject to its provider's terms.
You must provide a valid email address to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
When you connect a third-party account (such as TikTok, Instagram, or X/Twitter) to Hogmatix, you authorize us to access and use that account solely to provide the Service. Your use of connected platforms is also subject to those platforms' own terms of service. You are solely responsible for ensuring your use of Hogmatix complies with each platform's policies, including:
We are not responsible for actions taken by third-party platforms, including account suspensions or content removals resulting from your use of the Service.
Instagram: Instagram is a product of Meta Platforms, Inc. Hogmatix publishes only to Instagram professional (Business or Creator) accounts you connect through Instagram Login, and only the photos and reels you compose and submit in Hogmatix, at the time you choose. We request instagram_business_basic and instagram_business_content_publish to display your account and publish your posts. You are responsible for making sure what you post follows Instagram's terms and guidelines above. Instagram limits how many posts an account can publish through apps each day. You can disconnect an account at any time with the Disconnect button on the Instagram tab; also remove Hogmatix in Instagram under Settings → Website permissions → Apps and websites. How we handle Instagram data is described in our Privacy Policy.
You agree not to use Hogmatix to:
You retain ownership of all content you create and publish through Hogmatix. You are solely responsible for the content you post and must ensure it does not violate any laws or third-party rights, including intellectual property, defamation, and privacy laws. We do not review content before it is published and are not liable for any content posted through your account.
Hogmatix uses the TikTok API to publish content on your behalf. Your use of TikTok features within Hogmatix is subject to:
We request user.info.basic and video.publish to display your account and post videos you approve.
You may revoke Hogmatix's access to your TikTok account at any time using the Disconnect TikTok button inside the app or through TikTok's app permission settings. Revoking access will prevent Hogmatix from publishing to TikTok on your behalf but will not automatically delete your Hogmatix account.
Branded content and paid promotion: If a video you post through Hogmatix promotes your own brand or is a paid promotion for a third party, you must enable the corresponding commercial-content disclosure toggle in the composer. You are responsible for ensuring your posts comply with the TikTok Branded Content Policy, including all applicable advertising-disclosure laws.
Automation and authenticity: Hogmatix is a scheduling and posting tool. You — not Hogmatix — are responsible for the content you submit. Do not use Hogmatix to generate spam, coordinate inauthentic behaviour, evade rate limits, or otherwise violate TikTok's policies. We may suspend accounts that we believe are being used to abuse the TikTok platform.
AI-generated media: Hogmatix can generate images, captions, and videos using third-party AI providers. AI output can be inaccurate, unsuitable, or similar to existing material. You must preview every final video, review its caption and posting time, choose the current TikTok privacy and disclosure settings, and provide explicit consent before it is submitted. Reject any output you do not want published.
Metrics: Performance views show only fields supplied through the authorized platform APIs. They do not represent watch time, retention, completion rate, or follower conversion unless those fields are expressly added in a future supported integration.
Hogmatix may offer paid subscription tiers. Fees, billing frequency, and payment terms will be disclosed at the point of purchase. All fees are in USD unless otherwise stated. We reserve the right to change pricing with 30 days' notice. Refunds are provided at our discretion on a case-by-case basis.
Subscriptions and free trials. Subscriptions are sold by Forge Analytics & Systems Inc. and processed by Stripe. Stripe checkout, the billing portal, Stripe's billing emails and receipts, and your card statement may show PorkiCoder, the name of our Stripe account. First-time subscribers may be offered a free trial; checkout shows its length and the date of the first charge. A payment method is required to start a trial. Unless you cancel before the trial ends, your subscription converts to a paid subscription at the price shown at checkout and renews automatically each billing period until you cancel. You can cancel at any time through Manage billing in Hogmatix. If a payment fails, update your card in Manage billing or through the link in Stripe's payment email, or email [email protected]. If you cancel before the trial ends, you are not charged. Once you cancel, your subscription does not renew. Trials are limited to one per customer.
You may delete your account at any time by contacting [email protected]. We reserve the right to suspend or terminate your account immediately if you violate these Terms, without liability to you. Upon termination, your right to use the Service ceases and we will handle your data as described in our Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CONTENT WILL BE PUBLISHED WITHOUT DELAY.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FORGE ANALYTICS & SYSTEMS INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Forge Analytics & Systems Inc. and its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms or any third-party rights.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
We may update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
